Kids Gameplay, respects the intellectual property rights of others and expects our users to do the same. This DMCA Policy outlines our procedures for addressing claims of copyright infringement on our website at https://kidsgameplay.com/ .

What Is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a process for copyright owners to notify online service providers about infringing content and request its removal.

We are committed to:

  • Respecting the intellectual property rights of game developers, publishers, and other content creators
  • Responding promptly to valid copyright infringement claims
  • Removing infringing content when properly notified
  • Complying with the DMCA’s notice and takedown procedures

Scope of This Policy

This DMCA Policy applies to:

  • Content posted on our Site
  • User-generated content (comments, submissions, etc.)
  • Images, screenshots, and media we display
  • Any other content that may be subject to copyright protection

Note: We use game screenshots, logos, and promotional materials under fair use principles for the purpose of commentary, criticism, and review. However, we will respond to valid DMCA notices if copyright owners believe our use exceeds fair use.

If you believe that content on our Site infringes your copyright, you may submit a DMCA takedown notice.

Subject Line: “DMCA Counter-Notification”

What Happens After a Counter-Notification

Upon receiving a valid counter-notification:

  1. We will forward it to the original complainant
  2. We will inform them that we will restore the content within 10-14 business days
  3. The content will be restored unless the complainant files a court action seeking an injunction against the alleged infringement

4. Repeat Infringer Policy

We take copyright infringement seriously and will take appropriate action against repeat infringers.

Consequences for Repeat Infringement

Users who repeatedly post infringing content may face:

  • Warnings for first or minor offenses
  • Temporary suspension of commenting or posting privileges
  • Permanent account termination for serious or repeated violations
  • IP bans in cases of egregious abuse

What Constitutes a Repeat Infringer

A repeat infringer is someone who:

  • Has received multiple valid DMCA notices
  • Continues to post infringing content after warnings
  • Knowingly and willfully violates copyright

Appeals Process

If you believe your account was terminated in error, you may contact us to appeal the decision. We will review appeals on a case-by-case basis but reserve the right to make final determinations.

5. Fair Use and Our Content

We believe that our use of game screenshots, logos, and promotional materials constitutes fair use under U.S. copyright law for the following reasons:

Purpose and Character of Use

  • Our use is transformative: We use images for commentary, criticism, and review
  • Our use is non-commercial in nature (even though we earn affiliate commissions, the primary purpose is informational)
  • We add original commentary and analysis rather than simply reproducing content

Nature of the Copyrighted Work

  • Most content we use is factual or promotional in nature
  • We use publicly available materials (screenshots, promotional images)

Amount and Substantiality

  • We use only what is necessary to illustrate our reviews
  • We do not reproduce entire games or substantial portions
  • Screenshots and images are low-resolution and representative only

Effect on Market Value

  • Our reviews serve a different purpose than the games themselves
  • Our use does not substitute for the original work
  • Our reviews may actually increase interest in and sales of games

Copyright Owners’ Rights

While we believe our use constitutes fair use, copyright owners have the right to disagree. If you believe our use exceeds fair use, please submit a DMCA notice as outlined above, and we will review your claim.

6. Misrepresentations and False Claims

Submitting a false or fraudulent DMCA notice or counter-notification may result in legal consequences.

Consequences of False DMCA Notices

Under Section 512(f) of the DMCA, anyone who knowingly materially misrepresents that:

  • Material is infringing, or
  • Material was removed or disabled by mistake

…may be liable for damages, including costs and attorney’s fees.

Good Faith Requirement

Before submitting a DMCA notice, please ensure that:

  • You are the copyright owner or authorized agent
  • The content actually infringes your copyright
  • The use does not qualify as fair use
  • You have considered whether the use is licensed or authorized

Our Right to Refuse Invalid Notices

We reserve the right to:

  • Reject notices that do not meet DMCA requirements
  • Request additional information before processing a notice
  • Refuse to process notices from parties with a history of false claims

7. Limitations and Disclaimers
